If you reside in the United States and your Private Information was compromised in the Data Breach discovered by New River Electrical Corp. (NREC) in May 2024, including all individuals who received NREC's notice of the breach, then you may be a Settlement Class Member and eligible for benefits. Excluded from the Settlement Class are: (i) Defendant and Defendant’s parents, subsidiaries, affiliates, officers and directors, and any entity in which Defendant has a controlling interest; (ii) all individuals who make a timely election to be excluded from this proceeding using the correct protocol for opting out; (iii) any and all federal, state, or local governments, including but not limited to their departments, agencies, divisions, bureaus, boards, sections, groups, counsels and/or subdivisions; (iv) the attorneys representing the Parties in the Action; (v) all judges assigned to hear any aspect of the Action, as well as their immediate family members; and (vi) any person found by a court of competent jurisdiction to be guilty under criminal law of initiating, causing, aiding or abetting the Data Breach, or who pleads nolo contendere to any such charge.

If you are a Settlement Class Member and wish to receive Settlement Benefits then you must submit a Claim Form by July 20, 2026

The Settlement provides the benefits described below and is subject to an aggregate cap of $425,000.00, which will be used to pay Settlement Class Member Benefits, the Costs of Notice and Claims Administration, Attorneys’ Fees, Costs, and Expenses awarded by the Court, and any Service Award to the Representative Plaintiff approved by the Court. The benefits are explained in more detail below.

Credit Monitoring. Settlement Class Members are eligible to enroll in two (2) years of Credit Monitoring Services through one bureau.

Expense Reimbursement. If you incurred actual, documented out-of- pocket losses due to the Data Incident, you can get back up to $3,000.00. The losses must have occurred between April 30, 2024, and July 20, 2026, and cannot have already been reimbursed through any other source. This benefit covers out-of-pocket expenses like:

  1. unreimbursed costs to obtain credit reports;

  2. unreimbursed fees relating to a credit freeze;

  3. unreimbursed card replacement fees;

  4. unreimbursed late fees;

  5. unreimbursed over-limit fees;

  6. unreimbursed interest and fees on payday loans taken as a result of the Data Breach;

  7. unreimbursed bank or credit card fees;

  8. unreimbursed postage, mileage, and other incidental expenses resulting from the Data Breach; and

  9. unreimbursed costs associated with up to two year of credit monitoring or identity theft insurance purchased after April 30, 2024, and prior to the Effective Date, with certification that it was purchased primarily as a result of the Data Breach.

The amount of the expense reimbursement shall be decreased on a pro rata basis to the extent a reduction is required due to the number of valid claims filed exceeding the amount of funds available for these payments.

You need to send proof, like receipts or other documentation not “self- prepared” by the claimant that document the costs incurred. “Self- prepared” documents such as handwritten receipts are, by themselves, insufficient to receive reimbursement, but can be considered to add clarity or support other submitted documentation.

Alternative Cash Payment. In lieu of Expense Reimbursement, you can elect to make a claim for an alternative cash payment up to $50.00. No documentation is required to make this claim. The amount of the alternative cash payment shall be decreased on a pro rata basis to the extent a reduction is required due to the number of valid claims filed exceeding the amount of funds available for these payments.

The deadline to submit a Claim Form online is July 20, 2026. If you are mailing your Claim Form, it must be mailed with a postmark date no later than July 20, 2026.
